Terms of Service for Electronic Services

TERMS OF SERVICE FOR ELECTRONIC SERVICES

for the SoftPowerLab.pl website – contact form and newsletter services

(These Terms are prepared pursuant to Article 8(1)(1) of the Act of 18 July 2002 on the Provision of Electronic Services.)

1. Definitions

Whenever the following terms are used in these Terms, they shall have the meanings set out below:

Service – the website available at https://softpowerlab.pl, operated by the Operator. The Service includes, among other things, a blog (article publications) and provides Users with the electronic services described in these Terms.

Operator – Ireneusz Nieznański, conducting unregistered activity/business activity under the name “Ireneusz Nieznański Consulting” (or other applicable legal status), correspondence address: ul. Przasnyska 4a/146, 01-756 Warsaw, Poland, Tax ID (NIP): 521 269 04 43, e-mail: i.nieznanski@softpowerlab.pl. The Operator is a service provider within the meaning of the Act on the Provision of Electronic Services, providing services by electronic means.

User – any natural person visiting the Service and using electronic services provided by the Operator (both a person submitting an inquiry via the contact form and a person subscribing to the newsletter). A User may be a consumer or a person acting as part of their professional activity.

Services – services provided electronically by the Operator via the Service, referred to in Section 2 below. For the purposes of these Terms, the Services include:

  • Contact Form Service – enabling the User to send a message to the Operator using the interactive form available in the Service (the “Contact” section).

  • Newsletter Service – sending, with the User’s consent, informational and promotional content (a newsletter) by e-mail.

Contact Form – an interactive online form made available in the Service, enabling the User to provide contact details (e.g., first name, last name, e-mail address, phone number) and the content of an inquiry to the Operator.

Newsletter – an electronic message (e-mail) sent periodically by the Operator to subscribers, including, among other things, information about new blog posts, updates, SoftPowerLab’s offer, or other commercial information relating to the Operator’s activity.

Terms – these Terms of Service for electronic services. The Terms are made available to Users free of charge via the Service in a form enabling downloading, saving, and printing.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (General Data Protection Regulation).

Act on the Provision of Electronic Services (APES) – the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2002 No. 144, item 1204, as amended).

2. General provisions

2.1. These Terms define the rules under which the Operator provides electronic services to Users, including in particular:

  • the conditions for using the Contact Form and the Newsletter,

  • the rights and obligations of the User and the Operator related to these services,

  • rules on the protection of Users’ personal data in connection with the provided services.

2.2. Using the Services requires prior review and acceptance of these Terms. Acceptance is expressed by ticking an appropriate checkbox with the wording “I accept the Terms of Service for Electronic Services” when using a given service (e.g., when submitting the contact form or subscribing to the newsletter). Failure to accept the Terms makes it impossible to use the Services.

2.3. The Operator makes these Terms available free of charge via the Service before the conclusion of an agreement for the provision of electronic services. The Terms are available at softpowerlab.pl/regulamin in a form enabling the User to download and print them. The Terms may also be preserved by sending them to the User’s e-mail address upon request.

2.4. Using the Service and the Services requires a device with Internet access and an up-to-date web browser supporting JavaScript and cookies. Using the latest versions of browsers is recommended for proper operation.

2.5. The User is obliged to use the Service and the Services in a lawful manner, in accordance with good customs, and with respect for personal rights and intellectual property rights of the Operator and third parties. The User is prohibited from providing unlawful content (e.g., vulgar language, content infringing third-party rights) when using the contact form or other communication channels.

3. Scope and conditions of service provision

3.1. The Operator provides the following Services to Users by electronic means:

a) Contact Form Service – enabling the User to send a message to the Operator via the contact form. This is a one-off service. The agreement for this service is concluded when the User begins using the form (enters the “Contact” page) and is performed when the form is submitted and received by the Operator’s ICT system.

b) Newsletter Service – periodic sending by the Operator to the User’s e-mail address of messages containing information related to SoftPowerLab’s activity, including commercial information about the Operator’s services or initiatives, updates, blog articles, etc., provided the User has consented to receive such messages (newsletter subscription). This is a continuous subscription-based service. The agreement is concluded when the User confirms the subscription (double opt-in) and remains in effect until the User unsubscribes or the Operator stops sending the newsletter.

3.2. Using the Contact Form

3.2.1. Sending a message via the Contact Form requires completing mandatory fields (e.g., first and last name, e-mail address, message content) and (i) ticking the checkbox confirming acceptance of these Terms and (ii) ticking consent to personal data processing – in line with the information clause displayed with the form.

3.2.2. After correctly completing the form and clicking “Send”, the message will be transmitted to the Operator. The Operator will make reasonable efforts to respond within 14 business days (where a response is required). Response time may be longer during periods of increased inquiries or for reasons beyond the Operator’s control (e.g., outages).

3.2.3. The Contact Form Service is provided free of charge. The User may use it at any time, except during technical breaks in the operation of the Service.

3.2.4. The User may stop the submission at any stage before clicking “Send”. If, after sending, the User wishes to withdraw the inquiry (e.g., no longer wants a response), the User should promptly contact the Operator by e-mail and inform them of the withdrawal. The Operator will respect such withdrawal and stop processing the form data (except for retaining information for archival purposes if contact has already occurred).

3.3. Using the Newsletter

3.3.1. Subscribing requires entering an e-mail address in the subscription form available in the Service (e.g., in the “Newsletter” section) and ticking consent to receive the newsletter (and acceptance of these Terms as described in Section 2.2). The User then receives an e-mail requesting confirmation of the subscription (activation link) – a double opt-in mechanism confirming consent.

3.3.2. Upon clicking the confirmation link, the agreement for the Newsletter Service is concluded. If the User does not click the link, the subscription will not be activated and the provided e-mail address will be deleted from the temporary database after some time.

3.3.3. The newsletter is sent free of charge, with a frequency of up to [●] times per month (a typical frequency is 1–2 times per month, depending on blog activity). The Operator reserves the right to change the frequency or content, and will inform subscribers accordingly.

3.3.4. Newsletter content may include commercial information within the meaning of the APES, relating to the Operator’s own services and initiatives or those of entities connected with the Operator. By subscribing, the User consents to receiving such information (in accordance with Article 10(2) APES).

3.3.5. The User may unsubscribe from the newsletter at any time (which constitutes termination of the agreement for the Newsletter Service). Unsubscribing is possible by:

  • clicking the “Unsubscribe” link (or similar) in the footer of each newsletter; or

  • sending a request to the Operator’s e-mail address (e.g., using the phrase “Unsubscribe from the newsletter”), preferably from the same e-mail address that was subscribed.

3.3.6. After unsubscribing, the Operator will not send further newsletter messages to that address. Subscriber data may, however, be processed for a certain time to document consent and its withdrawal (as described in the Privacy Policy).

3.3.7. The Operator reserves the right to discontinue the Newsletter Service at any time (e.g., to close the newsletter). In such case, subscribers will be informed (e.g., in an e-mail or on the Service), and their data will be deleted from the newsletter database unless another legal basis for further processing applies.

3.4. Technical requirements and risks

3.4.1. To use the Services properly (form, newsletter), the User should have an active e-mail address and an Internet connection.

3.4.2. The Operator is not responsible for difficulties caused by technical issues on the User’s side (e.g., Internet outage, anti-spam filters blocking our e-mails, a full mailbox, etc.).

3.4.3. Services are provided via the public Internet, which involves typical risks. The User should apply protective measures on their own (antivirus, software updates, caution regarding suspicious messages). The Operator uses SSL encryption and appropriate server safeguards to minimize risks on its side.

4. Personal data protection

4.1. The Operator is the controller of Users’ personal data (identification details provided in Section 1). Users’ personal data is processed for purposes related to providing the Services:

  • data provided in the contact form – to handle the inquiry (legal basis: legitimate interest or consent, in accordance with the Privacy Policy),

  • e-mail address for the newsletter – to send the newsletter (legal basis: subscriber’s consent),

  • other data (e.g., for comments or accounts, if applicable) – as appropriate for the purpose for which it is provided.

4.2. Detailed information on personal data processing (including rights of data subjects, retention periods, recipients, etc.) is contained in the Privacy Policy available in the Service. The Privacy Policy forms an integral part of these Terms.

4.3. Providing personal data is voluntary, but necessary to use a given electronic service (e.g., lack of an e-mail address prevents providing a response or sending the newsletter).

4.4. The User is obliged to provide truthful data. Using third-party data without authorization is prohibited. If false or чужy data is identified, the Operator may block provision of the Service to such User and take legal steps if a violation occurred.

4.5. The Operator applies organizational and technical measures to protect Users’ personal data in accordance with applicable regulations (GDPR and relevant national laws).

5. Rights and liability of the parties

5.1. Operator’s liability

The Operator undertakes to provide the Services with due care, but is not liable for:

  • interruptions or disruptions caused by force majeure, hardware failure, unauthorized third-party interference, or incompatibility of the User’s infrastructure;

  • consequences of the User sharing access to their e-mail account (or other confidential data) with third parties – the User is responsible for keeping such data confidential;

  • the content of messages sent by the User via the contact form (the Operator acts as a transmission intermediary within the meaning of the APES, does not initiate the transmission, and only provides the technical means);

  • damages resulting from the User relying on information contained in newsletters or on the website to the extent such information is general in nature. (Clarification: SoftPowerLab content – e.g., articles – reflects opinions and information, not legal advice; the User acts at their own responsibility, which may also be stated in disclaimers next to articles.)

5.2. User’s responsibility

The User is responsible for how they use the Service and the Services. In particular, the User undertakes:

  • not to provide unlawful content (e.g., defamatory content, content infringing personal rights, spam, malware) via the form or other channels;

  • not to distribute content received in the newsletter that constitutes copyrighted works (e.g., articles, studies) without the Operator’s consent — such content is intended for the subscriber’s personal use;

  • to use the Services in a manner that does not disrupt the Service (e.g., no hacking attempts, no excessive server load).

5.3. Suspension or termination of Services

The Operator may stop providing Services to a User who grossly violates these Terms or applicable laws (e.g., attempts phishing via the form, breaches security). For newsletter subscribers, the Operator may immediately remove a subscriber if the Operator determines the subscriber’s actions violate these Terms or the law (e.g., a confirmed objection to processing). The Operator will inform the User of such decision where possible, including the reasons.

5.4. Complaints procedure

The User may submit complaints regarding the provision of electronic services. Complaints should be sent by e-mail to the Operator or in writing to the correspondence address. The complaint should briefly describe the issue. The Operator will review the complaint within 14 days of receipt and respond using the contact details provided by the User (e-mail or postal address).

5.5. Amendments to the Terms

The Operator reserves the right to unilaterally amend these Terms in the event of:

  • changes in legal provisions governing the Services or changes in their interpretation due to court rulings or administrative decisions,

  • changes to functionality or introduction of new services in the Service,

  • the need to correct errors or clarify provisions.

The Operator will inform Users about planned amendments via a notice on the Service or by e-mail (for newsletter subscribers). Amendments take effect no earlier than 7 days from notification, unless they concern newly introduced Services (then they apply from the indicated date). Continued use of the Services after amendments take effect constitutes acceptance of the updated Terms. If the User does not accept the amendments, the User should stop using the Services (in particular, may unsubscribe from the newsletter).

5.6. Final provisions

In matters not regulated by these Terms, generally applicable provisions of Polish law apply, including in particular the Act on the Provision of Electronic Services, the GDPR, and the Civil Code. These Terms do not exclude or limit any consumer rights granted by mandatory law. In the event of any conflict between these Terms and such mandatory provisions, the mandatory provisions prevail.

These Terms enter into force on 28.01.2026 and apply to Services provided from that date.
